World's largest ukulele ensemble sets record in Japan
The Japanese group played their way into the Guinness Book of World Records on Saturday at an event held in Yokohama, south-west of Tokyo.
Thousands of musicians, of all ages, headed to the Japanese capital where they performed together to set the new world record.
The ensemble entertained world record officials with an interpretation of Aloha Mahalo A Hui Ho, a song written by Hawaiian-born former sumo wrestler Konishiki.
Konishiki, who retired from wrestling in1997 as then heaviest sumo of all-time, joined the ensemble on stage to also become a world record breaker.
Consisting of 2,134 people, the world record eclipsed a record set in Sweden last year consisting of 1,547 players.
The Japanese performance was part of Ukulele Picnic Week which also featured hula dancing.
Largely associated with Hawaii, the string instrument was introduced to The Aloha State by Portuguese immigrants in early 1880s.
It reached Japan by 1929, where it quickly gained popularity as enthusiasm for western music grew in the years leading up to World War II.

Poll: Gun control views unchanged after Colorado massacre
WASHINGTON (Reuters) - Americans' views on gun control remain largely unchanged despite the killing of a dozen moviegoers in a Colorado theater this month, a Pew poll showed on Monday.
Forty-seven percent of Americans say it is more important to control gun ownership, while 46 percent say it is more important to protect the rights of Americans to own guns, the Pew Research Center for the People & the Press said in a statement.
The numbers are virtually unchanged from April, when 45 percent prioritized gun control and 49 percent gun rights. Other major episodes of gun violence in recent years also had little effect on public opinion about gun laws, Pew said.
James Holmes, a former University of Colorado graduate student, was formally charged on Monday in the shooting deaths of 12 people in the shootings at an Aurora, Colorado, theater on July 20.
Sixty-seven percent of those polled say that shootings like the one in Colorado are the isolated acts of troubled individuals. Twenty-four percent say such shootings reflect broader problems in U.S. society.
Hughes had bought 6,000 rounds of ammunition online. Senator Frank Lautenberg of New Jersey and Representative Carolyn McCarthy of New York said they were proposing limits on anonymous online or mail-order purchases of ammunition.
The legislation also would require reporting of bulk ammunition sales.
President Barack Obama pledged last week to work to "arrive at a consensus" on how to reduce gun violence.
The Pew survey was conducted July 26 to 29 among 1,010 adults.

NBC Olympic Coverage Critic Guy Adams Had Twitter Account Suspended [UPDATE]
Twitter has suspended the account of British journalist Guy Adams (@guyadams), in the wake of his fierce criticism of NBC?s Olympic Coverage. Adams, the Los Angeles correspondent for Britain?s ?The Independent,? had a scathing stream of tweets about the network?s coverage, pointing out factual errors and asking if car advertising was an Olympic sport. It appears, however, to have been revealing the email address of NBC Universal?s ?President, NBC Olympics? Gary Zenkel that earned his account suspension.
It is not clear what rule Adams violated. Twitter has a policy against the release of someone?s ?private and confidential information,? but an email address does not seem to be on the same plane as a credit card number, a social security number or a street address. Twitter has a partnership with NBC Sports to promote the games, which likely explains the broad interpretation of the rule. It might also explain how ?#NBC? was a twitter trend but ?#NBCfail? was not.
Adams is purportedly publishing a piece in response to the banning. This is more horrendous PR for NBC and it?s only the fourth day.

It?s no more ?private? than the address I?m emailing you from right now. Either way, [it's] quite worrying that NBC, whose parent company are an Olympic sponsor, are apparently trying (and, in this case, succeeding) in shutting down the Twitter accounts of journalists who are critical of their Olympic coverage.?

I bought a mini-trampoline this weekend. I was looking for a piece of home fitness equipment that met one specific requirement ? it had to fit into a 3-foot square area of my bedroom.
All those infomercials that promise muscle toning, core-strengthening, and cardio training neglect to answer the most important question: Will the device fit in your house?
Or will you have to remove a major piece of furniture such as the sofa, requiring your guests to perch along the edge of the AbFlexGlideRowArator whenever they come over for margaritas and tofu chili?
Maybe you have a 3600 square foot house with a room designated as ?the home gym,? but I?m lucky to have a room designated as ?the bathroom.? The rule around here is nothing new comes in without something old being donated to Goodwill.
This is one reason I never have long-term guests ? they worry that I may get up early, hit a few garage sales and come home with a floor lamp that takes up the same amount of space they do. It?s a legitimate concern; just ask my half-sister. She was exactly the same size as the wicker clothes hamper I found while she was visiting from California.
When I discovered the mini-tramp (love that word, by the way) at a local sporting goods store and realized it would fit in the bedroom without having to take anything out, I was ecstatic. It didn?t hurt that it was only $39 and came in one sleek box. I?ve had my fill of exercise equipment that arrives in multiple boxes and requires a screwdriver, wrench, hammer, ratchet set, drill press, circular saw, GPS device, latex gloves, and six rolls of duct tape to assemble.
I managed to put the mini-trampoline together in less than 15 minutes with just a wrench and the enclosed motivational CD featuring a sexy-sounding man with an Italian accent repeating, ?You?re a smart and talented woman who can put together this product by yourself. And did I mention how attractive you are?? I got up to my target heart rate just listening to his dulcet tones.
My new ?gym? is located right in front of a window so that I can look out at the birds and squirrels while I work out. Perhaps twenty-seven years of living with dogs has affected my brain, but I always feel more energetic when I see creatures darting across the yard. And if I yell ?Squirrel!? my dogs also get a workout. It?s win-win. The only thing I have to be careful of is not getting overly enthusiastic and hitting my head on my 7-1/2-foot ceiling. I?m pretty sure a concussion doesn?t burn extra calories.
Before engaging in my first official bouncing session, I posted the yellow laminated ?Trampoline Use Instructions? card in a highly visible place as suggested by the manual. I tacked the card to the closest wall and took a moment to read it over.
- Do not allow more than one person on the trampoline at a time. As far as I can tell, the only way that would be possible is if you had a small infant strapped to your chest. So please, if you break into my house with the intent of working out on my mini-trampoline and you happen to have a small infant strapped to your chest, remove said infant prior to getting on the equipment.
- Use trampoline only with mature, knowledgeable supervision. Well drat! Where am I going to find someone mature? I have no idea where to even start looking. The most mature person nearby is a neighbor in her eighties, but last week she put Spongebob Squarepants stickers on her bicycle helmet and did her hair like Pippi Longstocking, so she?s out.
- While keeping the head erect, focus eyes on the trampoline toward the perimeter. I?m sorry, but if my head is erect, I cannot see the trampoline. I know I?m supposed to have a third eye, but not in my ankles. Good thing I have the wiener dogs to keep watch on the perimeter for me? when they?re not running for the squirrels.
- Do not use the trampoline while under the influence of alcohol or drugs. I?m willing to forgo the booze prior to working out, but what kind of drugs are they talking about? I?m on the estrogen patch and really think using the equipment while experiencing mood swings and hot flashes may be the more dangerous choice. Perhaps I should ask my doctor.
- Make sure to use the bathroom before using the device. Okay, it didn?t say that, but it should. So I scribbled it on the bottom of the list. I don?t want to take any chances.
I?m ready now for my first real workout. Assuming I can find a mature person somewhere.

Australia edges US to lead way into men's relay final
Confident Australian James Magnussen backed up his brash talk as he overhauled US veteran Jason Lezak to put his team in pole position for the 4x100m freestyle relay Olympic final on Sunday.
Magnussen, in his first swim of the London Games, clocked a sizzling 47.35 seconds in the final leg as he turned the tables on front-runner Lezak, who famously overtook France to claim gold for the United States in 2008.
Australia had trailed the Americans from halfway, but world champion Magnussen dived in at the last change to qualify his team top in 3:12.29 -- grabbing the coveted lane four for Sunday night's final.
Defending champions America were second quickest in 3:12.59, ahead of Russia (3:12.77) and France (3:13.38).
Magnussen, who insists the individual 100m freestyle is his to lose, had earlier spoken of his deep admiration for Lezak's come-from-behind swim in 2008.
"I felt nice and relaxed in the first 50 and I just let the crowd carry me home at the end," he said.
Australia's Jason Roberts, the second-fastest in the 100m this year, registered 48.22sec as the second swimmer in a top-strength quartet.
It is unusual for the leading relay teams to use their big names in the morning heats, but Australia were looking for the favoured lane four in their bid to down the American defending champions.
In Magnussen and Roberts, Australia have the fastest two men in the world this year by a wide margin, while former world record-holder Eamon Sullivan and world champion Matthew Targett are also expected to feature in the final.
The Americans, who are expected to bring in Nathan Adrian, winner of the individual 100m free at the US trials, Cullen Jones and Michael Phelps for the final, have won eight of the 10 Olympic gold medals awarded in the event.
Head US coach Gregg Troy was keeping the makeup of his team secret for the final.
"We've talked about it and have decided on the team composition, but we have to give ourselves the best chance of winning," Troy said. "This is the best 400 relay field ever."
The USA won the first seven Olympic editions of the event, from 1964-1996, before Australia ended their unbeaten run in an epic showdown in Sydney -- where Gary Hall Jnr had vowed to smash the Aussies "like guitars".
South Africa seized the gold in Athens four years later in the Americans' only defeats at the Olympics.

Can the children decide whom to live with ... - Family Law Attorney
When can the children decide what parent they want to live with?? This is a common question asked.? Parents must insure not to use their children as pawns against the other parent because doing so can lead to emotional and psychological harm to minor children involved.? During a divorce there will be anger, and hurt feelings but both parents must attempt to keep their children?s best interest in mind when creating a custody and visitation plan.
So what is the answer to our question? California Family Code ?3042, provides some guidance to help answer this question, in that it states that ?if a child is of sufficient age and capacity to reason so as to form an intelligent preference as to custody or visitation, the court shall consider, and give due weight, to the wishes of the child in making an order granting or modifying custody or visitation?.? This same code was amended to include a provision that if the child is 14 years of age or older and wants to talk to the Judge about custody and visitation, the child shall be permitted to do so, unless the court determines that it would not be in the best interest of the child. If the child is not permitted to speak then the court shall state the reasons on the record.
This same code then goes on to say that nothing in the section shall be interpreted to prevent a child younger than 14 from addressing the court about custody or visitation, if the Judge determines that it is appropriate and in the children?s best interest.? If the child is not allowed to speak the court shall provide an alternate form of obtaining the child?s input such as appointing an attorney for the child, a mediator or ordering an investigation.
As you can see there is no real easy answer to the question and no set age at which the child can decide or control with whom they will live.? There are many factors to consider in making custody and visitation orders.

NEW YORK (AP) ? Preliminary estimates show that Saturday night's NBC telecast scored the highest ratings for the first evening of an Olympics competition outside of the United States.
The Nielsen company said Sunday that its measurement of the nation's largest cities showed ratings for the Olympics telecast were up 8 percent over opening night in Beijing four years ago. A fuller measurement of viewership is expected later on Sunday.
NBC was the target of many Twitter complaints on Saturday for not telecasting the marquee men's swimming competition live, instead showing it on tape delay in prime-time. But prime-time ratings are the report card that the company cares about the most and, thus far, viewers are responding to the strategy.

Now that the Supreme Court has upheld the Affordable Care Act, it?s time to start picking through the details. Several key tax rules are scheduled to change in 2013, especially for higher-income individuals.
Republicans are still trying to overturn the law, and that could happen based on what transpires in the November election. But if nothing changes, here?s what to expect in terms of the health-related tax impact, with focus on items that apply to individuals rather than businesses:
New Medicare tax. Higher payroll withholding is on the horizon with the introduction of a 0.9 percent tax starting in 2013. It will hit people with earned income exceeding $200,000 for singles and $250,000 for married couples filing jointly. That?s in addition to the current Medicaid tax of 1.45 percent.
New investment-income tax. The legislation also imposes a 3.8 percent levy on interest, dividends, some rents and other unearned income for people above those $200,000/$250,000 income levels. This levy, also designed to support Medicare, starts in 2013.
?This 3.8 percent tax would be on top of any increase in the dividends/capital-gains/ordinary-income rates that (take effect) ? upon expiration of the Bush-era tax cuts at the end of 2012,? according to tax-researcher CCH.
Top rates rising. That 3.8 percent Medicare addition plus scheduled regular-tax increases mean the top effective rate for high-income earners could go from the current 35 percent to 43.4 percent in 2013, said Jason Miller, manager of financial planning at Harris Private Bank in Scottsdale. The capital-gains rate could go from a top 15 percent this year to 23.8 percent next year.
Harvesting or prematurely locking in capital gains, normally an unwise strategy, could make sense, Miller added. So could accelerating income into 2012 rather than deferring it, if possible. In one strategy cited by Mark Luscombe, principal analyst at CCH in suburban Chicago, you might opt to convert a regular IRA into a Roth, paying the applicable taxes at this year?s lower rates and thereby securing tax-free withdrawals in future years.
Incidentally, selling a home for a large capital gain after this year could be costly, since the gain could increase net investment income and boost adjusted gross income above the $200,000/$250,000 threshold amounts. However, most people won?t face the tax on a home sale, as individuals still will be able to shelter up to $250,000 and couples $500,000 in gains on the sale of a primary residence, said Luscombe.
In other words, the new 3.8 percent tax applies to housing capital gains above the $250,000/$500,000 limits only if your income exceeds the thresholds.
Sticks and carrots. The legislation requires most Americans to carry health insurance. People who refuse to obtain coverage will face a tax penalty, figured as the higher of a flat-dollar amount or a calculation based on a percentage of household income. The flat-dollar amount starts at $95 in 2014 and rises to $695 by 2016, with inflation adjustments after that, reports CCH.
?To determine the penalty, you make two calculations and pay it on the greater amount,? said Luscombe. ?But it?s not something to worry about now,? since the penalty starts in 2014.
Conversely, lower-income people who purchase health insurance might be able to qualify for federal help in the form of a premium-assistance tax credit, also starting in 2014. The formula is rather complex, especially since eligibility hinges in part on whether a person has access to affordable coverage through work. But in general, the tax credit is designed to help those with income modestly above the federal poverty level. It?s expected to average more than $5,000 annually per enrollee and will be refundable.
Then again, some people will be exempt from this requirement and thus the penalty. CCH says the list includes those unable to afford coverage (as determined by a formula), those currently covered by Medicaid and Medicare, members of Native American tribes, certain people objecting for religious regions, prisoners and people living outside the country lawfully.
Tougher deduction threshold. Though not directly related to the individual health-insurance mandate, taxpayers who itemize will find it harder to write off unreimbursed medical expenses starting next year. That?s because such expenses will be deductible only to the extent they exceed 10 percent of a person?s adjusted gross income. That?s up from a current threshold of 7.5 percent.
However, the 7.5 percent floor will continue to apply for people age 65 and older. . Arizona currently allows residents to deduct medical expenses in full, and it?s not clear if that might change.
Because medical deductions will be harder to qualify for next year, it might pay to incur certain expenses this year, if you?re close to or above the 7.5 percent mark but unlikely to hit 10 percent. This goes against the conventional tax-planning wisdom, which says deductions are best delayed until 2013 since they will help shelter income taxed at higher rates then.
IRS guidance. Almost every federal tax bill leaves a few question marks, and this one is no exception. So look for the Internal Revenue Service to issue regulations in coming months. As if it wasn?t busy enough, the IRS now will oversee and enforce the new health legislation.
?Concerns remain over how the IRS will interpret parts of the law as it continues issuing guidance to implement it,? said CCH. ?Many observers contend that the IRS is significantly underfunded at current levels to handle its expected multifacted role in implementing the health-care law,? said CCH.
Even if the IRS can seamlessly handle its new oversight duties, one thing is certain: Taxpayers will have a tougher time figuring everything out.
